- No purchase is necessary to enter or win. All federal, state, local and municipal laws and regulations apply. Void where prohibited. Must be present to be eligible to win the Grand Prize. Promotion period begins on January 27, 2008 and ends on August 15, 2008. All eligible entries will be entered in the drawing for Finalists for the Grand Prize.
- Agreement to official rules. By participating in the Ultimate Home Delivery Contest (also referred to as the "Promotion"), entrant fully agrees to and accepts these official rules and the decisions of Lincoln Journal Star (also referred to as the "Sponsor") which are final and binding in all respects. Failure to comply with the official rules will result in disqualification from the Promotion and forfeiture of any prize or of the right to any prize.
- Eligibility. Lincoln Journal Star Ultimate Home Delivery Contest is open to US residents (excluding residents of Puerto Rico, New York, and Florida), who are 21 years or older at the time of entry. Directors, officers, employees and members of employees' households and immediate family (spouses, parents, siblings, children, and each of their respective spouses), of Lee Enterprises, Journal Star Printing Co., and the Promotional Participants, are ineligible to enter the Promotion.
- Methods of entry. Paid home delivery subscribers of the Lincoln Journal Star will automatically be entered in the Promotion once each day a Lincoln Journal Star newspaper is scheduled for delivery to the subscriber's address. A "paid home delivery subscriber" is a person who receives home delivery of the Lincoln Journal Star newspaper by newspaper carrier delivery at his or her private residence by means of a subscription which is paid for in full at the time of delivery. Non-delivery of a newspaper due to carrier error does not affect the automatic entry once each day. Possession of a newspaper by a person other than the paid home delivery subscriber to that newspaper does not entitle the possessor to an entry. An alternative method of entry is to hand-deliver or to mail to the Lincoln Journal Star, at PO Box 81609, Lincoln NE 68501-1609, an entry consisting of a 3x5 white note card with the following information handwritten on the card: full name of entrant, contact information including street address of entrant, telephone number, date, and signature of entrant. Limit of one (1) hand or mail delivered entry per person, per day. Mechanically reproduced or hand-stamped entries, or mailing labels, or entries generated by script, macro or other automated means, will not be accepted. Incorrect, illegible, and incomplete entries are void. All entries become the exclusive property of the Lincoln Journal Star and none will be acknowledged or returned. No entries will be accepted after 5:00pm on August 15, 2008.
- Selection of Finalists. Ten Finalists will be selected in random drawings from among all eligible entries received during the Promotion (the "Finalist Drawings"). The odds of being selected depend upon the number of eligible entries received for each Finalist Drawing. The Sponsor will notify Finalists by telephone of their status as Finalist for winning the Grand Prize, or, as necessary, by email and United States Postal Service Express Mail. Finalists will be required to execute an affidavit of eligibility and release of liability and publicity and return the same to the Sponsor, fully executed within ten (10) days after notification. Finalists will have the option to decline the chance of being a Grand Prize Winner. If any entrant declines being a Finalist, or if the Sponsor is unable to notify a Finalist of his or her selection, another entrant will be selected in a random drawing from the remaining eligible entries. If any Finalist is determined to be ineligible, or fails to return all requested forms within the required time limits, or fails in any other way to comply with these official rules, then he or she is disqualified from the Promotion and forfeits his or her right to claim a chance on the Grand Prize.
- Selection of Grand Prize Winner. Finalists will be required to be present at the Grand Prize Winner Selection Event (the Event), on a date and at a time after August 15, 2008, to be announced by the Lincoln Journal Star. At the Event, each Finalist will be entitled to draw one of ten house keys, only one of which opens a door which will be located at the site of the Event. Each Finalist will use his or her key to attempt to open the door. The Finalist who has the key that opens the door will be the Grand Prize Winner. Finalists may appoint a representative to appear in their behalf at the Event. Failure of a Finalist or representative to appear at the Event will result in the disqualification of the Finalist and forfeiture of the right to claim a chance on the Grand Prize.
- Grand Prize. The Grand Prize consists of the newly-constructed home of the Grand Prize Winner's choice, from among the homes constructed for the Promotion by the Promotional Participants (the "Ultimate Homes"). Each of the Ultimate Homes will have an estimated market value of $300,000. Actual value of the Grand Prize depends on market conditions and fluctuations. Details about each of the Ultimate Homes regularly appear in the Lincoln Journal Star. The Grand Prize shall be conveyed to the Grand Prize Winner by means of a corporate warranty deed, and shall be transferred only with those representations and warranties provided by the Promotional Participant builder of the Ultimate Home chosen as the Grand Prize. The Promotional Participant shall be responsible for applicable real estate transfer taxes, including but not limited to, documentary stamp taxes, deed recording charges and closing costs. The Grand Prize shall be conveyed to the Grand Prize Winner without any representation or warranty by the Sponsor, express or implied. The Grand Prize is awarded as constructed by the Promotional Participant. The award of the Grand Prize is not contingent on or subject to any alterations or additions, including but not limited to painting, lighting, landscaping, driveways, sidewalks, and home furnishings. Any alterations or additions may be made only after the Grand Prize is awarded, and only at the Grand Prize Winners expense. Title insurance and homeowner's hazard and liability insurance shall be the sole responsibility of the Grand Prize Winner. The Grand Prize Winner must take legal possession of the Grand Prize within sixty days (60) from the date the Grand Prize is awarded, or else the Sponsor shall have the right to declare the award forfeited, and to name another Grand Prize winner by random selection from among the Finalists. The Grand Prize may not be transferred, substituted or redeemed for cash. The Grand Prize Winner may not transfer the Grand Prize prior to taking legal possession.
- Tax Liability. The Grand Prize Winner agrees to pay all applicable federal, state, and local taxes associated with the award of the Grand Prize, including income tax, all current and future real estate taxes, and all other taxes, costs, fees and expenses related to the ownership and maintenance of the Grand Prize. The Grand Prize Winner should consult with his or her tax advisor with respect to the tax consequences associated with winning the Grand Prize. The Grand Prize Winner will be issued a 1099 tax form for the value of the Grand Prize.
- Winners List. The Grand Prize Finalists and Winner will be posted online at JournalStar.com after the Grand Prize ceremony. This information will also be published in the Lincoln Journal Star newspaper.
- Publicity. Pursuant to prior written consent as provided in paragraph 5 above, the Finalists and the Grand Prize Winner agree to provide and to grant the Lincoln Journal Star and the Promotional Participants the absolute right and permission to use the Finalists' and the Grand Prize Winner's name, likeness, voice, opinions, biographical information, address, and photograph in any and all advertising and promotional materials, in any manner or media whatsoever, for purposes of advertising, trade or promotion. The Grand Prize Winner acknowledges and agrees that he/she shall have no right of approval, no claim to any compensation, and no claim arising out of the use, of his or her name, address, personal information, photograph or likeness.
- General Conditions. By participating in the Promotion, entrants agree to comply with and to be bound by the official rules and by all interpretations of the official rules by the Sponsor. Decisions of the Lincoln Journal Star shall be final in all matters relating to the Promotion. The Lincoln Journal Star reserves the right to modify, suspend, or cancel the Promotion if fraud, technical failures, or any other factor beyond the Lincoln Journal Star's reasonable control impairs the integrity of the Promotion and the integrity of the selection of the Grand Prize Winner as determined by the Lincoln Journal Star in its sole discretion. In such event, the Lincoln Journal Star reserves the right to award the Grand Prize in a random drawing from the eligible entries received up to the time of the impairment, or to implement any remedy it sees fit.
- Release. By entering the Promotion, all entrants agree to release and hold harmless the Sponsor and the Promotional Participants; each of their affiliates, parent companies, subsidiaries; and their respective officers, directors, employees and members, from and against any claim or cause of action arising in connection with each entrant's participation and/or entry in the Promotion and/or their receipt or use of any prize awarded in this Promotion.
- Sponsor. The Promotion is sponsored by the Journal Star Printing Co., d/b/a the Lincoln Journal Star and its parent company Lee Enterprises, Incorporated, whose decisions regarding the selection of Finalists winners and all other aspects of the contest shall be final and binding on all persons in all respects. Promotional Participants in the Promotion are Heritage Builders, Inc., Manzitto Bros., Integrity Builders, Inc., Goings Custom Homes, Inc., Aspen Builders, Inc., Heritage Lakes, Village Gardens Development Company LLC, Fallbrook, Waterford Estates, Wilderness Hills, and Lincoln Federal Savings Bank. The Sponsor is not responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the contest.
